Can they send me to collections

I had a car rental from Enterprise where the windshield they claim, was damaged under my use, but it was not.

They charged my card without my consent, so I called my MasterCard company to get back the money.

Now they are threatening to send me to collections and have sent several letters to my address.

Can they do this? I tried searching online but can’t seem to find an answer. Thinking of calling Equifax and Transunion.

    That’s why they ask you to do the walkaround before you leave their lot. If it was there and you didn’t note it, you’re responsible. That’s the contract you signed with enterprise.

    If they report it on your credit bureau,you are allowed to add a statement that you dispute the bill. Unfortunately most credit checked by computer only looks at the score,not the dispute so you may want to consider just paying it. The extra you have to pay in interest as a high risk debtor will cost more…in the future take pictures when you drop the vehicle off.

  4. Same scenario but different company, I called the regional head office to complain to no avail.i had a co worker who had the same experience as me with the same company but threatened legal action and the company backed off

  5. Personally, if you didn’t do it. Tell them to take you to court or drop it. They will have to prove you did the damages. And you can counter for your time and money if they keep coming after you.

  6. Write them an official letter that you are disputing their claim of the damaged windshield. If it wasn’t noted on their return inspection they cannot charge you. Fax and email it to them and advise you will not be paying that bill without evidence of return damage. For them to file a collection for $200 is a lot of effort, most times not worth it.

  7. Answer the letters and come to a resolution. It will be cheaper than the price you will be paying for having it show up as a negative on your credit report.

  8. I had that happen. They said there was damage found 2 days after I returned rental. I had to write head office disputing it, to get results. Luckily I still had return slip stating no damage was found at time of return. After the head office looked into it, they sided with me.

  10. Do you have the proof of the before as after inspection? If the damage was not reported on either paper tell them to stuff it! However if it was reported on the after and you just don’t want to pay..well own up because your screwed

  11. This exact thing happenned to me with enterprise years ago…I did not dispute the credit card charge though. Just weird coincidence I guess

  12. They did it to me two. Also charged me for a weekend once when I only rented for a day. Took me 8 months to get my money back.
    I now walk around the car and take a video of it before leaving.
    they always take the cars to the dealer for Windows also, so you pay big time.

  13. Sure, but unless the damage is thousands of dollars and worth going to court over then all they can do is threaten. However, learn your lesson and be more observant, it may not be so simple next time.

    Always always agree to the windshield insurance!!!! When i worked at a car rental agency we always had to write down any new marks on the walk around sheet n then compared it to the one when they first took the rental

  16. They tried it with me car had snow below the wipers before I left I cleaned the snow . There was a big Rick chip they tried to tell me I did it before I left the lot . I had paid for glass insurance so when it came back I made sure the windshield was smashed they tried to charge me for it I laughed I paid for glass insurance

    If they wrote down on the paper it was damaged upon bring back inspection and you signed it. It’s your fault. If they didn’t write that it was damaged and you signed it. It’s their fault

  18. I always do a video recorded walk around inspection check with talking about everything I see, verbally stating date and time and location, on getting the vehicle and the same again on the return of the vehicle.
    As I use rental vehicles on all my business trips out of town, and very good way to document any chances of troubles later.

    Basterds did that to me years ago, said i damaged front end …told them id be right there to see vehicle, They said its being fixed … they’re a bunch of crooks . Only rental place i wont rent from.

    When you left with the car, was the windshield broken or not… ? Seems like something you would mention on the vehicle damage inspection before you would take the car off the lot.
