Rant, I’m sorry guys but I need too!

As a waitress at a shitty place, I’ve realized I’m being scammed out of my tips. I need my job unfortunately so quitting isn’t an option. I’m looking for a new one though. But would it be any better?

My owners take a cut of whatever sales I bring in. Some days I owe them money because my tips are low. So it’s taken off my cheque. Or whenever I have the extra money in my float. I also had to come up with my own float.

I guess my question is…… Is it like this everywhere? Is 5/6% of whatever I make a lot to take from me? sometimes I think it’s more than that though. Or am I just sounding greedy?

  5. Highly illegal report them to CRA and employment standards. They are scammers

    • Actually they only illegal part is taking money off her pay check. The rest is pretty common in the industry even though it’s unethical

No Brenda, stealing tips is not legal. Whether it’s a 20 out of your wallet or your tip jar STEALING MONEY IS ILLEGAL.
What disturbs me the most is you don’t think taking someone else’s money from tips is legal.

  6. What they are doing is illegal and you should be calling the labour board! Wow.

  7. Please PM me where you work so I can be sure I never go there.

  8. They cannot take it off your check, but this makes it easy to prove they were breaking the law. Labor relations will look into that for you and require them to pay you back. It is normal for waitresses to be asked to bring their own float. It’s not everywhere but not illegal.
That percentage does seem higher than average. But again it’s legal.

if you’re losing money after tip out regularly I’d look for a new job, lots of restaurants in Edmonton

    • Taking it off her paycheck is illegal.. the other stuff is shitty but normal.. if every job you worked at also took it off your pay check you can call the labor board and complain and potentially get that money back.

Although there is no legislation in Alberta that deals with your tips, your comment regarding “owing” your employer is certainly concerning. An employer cannot take money from you or charge you for things that are just a cost of doing business. This includes breakages, shortages, dine and dash etc. The employment standards code addresses those issues under “deductions from pay” . I know it happens in a lot of places but it’s still a violation of the Code. Keep a record of any deductions of this nature as you can file a complaint to recover it. Please, though
, go to the Employment Standards (Alberta) website as there are a couple of exceptions. https://work.alberta.ca/documents/employment-standards-guide-for-hospitality-industry.pdf

    • Good idea. Or better yet, ask for documentation of the deductions directly from your employer. That will likely be enough for them to stop scamming you!

    • Lyn Hessels Lyn Hessels says:

Or download this brochure that I provided the link to and ask the employer why they are not following the legislation re deductions/charging employees for certain work events.

  13. No this is not normal. Something is up. They can’t make you pay them when your tips are low. Something is scammy here.

I can’t believe management gets any tip outs. Ours just stand around doing fuck all while we bust our asses, we do all the prep, serving, and cleaning. That’s so horrible.

    [0]
    • Prep, serving and cleaning isn’t the only thing that goes on in a restaurant. I was a restaurant manager for a while and the background shit is a LOT of work. However, managers should be there to support their staff. Good ones anyways.

      [0]
    • Jules Maria Jules Maria says:

Yeah, we’ll they get paid more. They aren’t the ones with the responsibility of over serving and getting fired, or conversations with customers. They don’t deserve jack shit of what I bust my ass off for. You try serving 600 drinks in around a 90 minutes. None of the managers I’ve had could do half of that.

      [0]
    • In other provinces it’s illegal for business owners and managers to take a share of the tips. In Alberta it’s allowed but in pretty bad taste for an owner to do so. They cannot deduct from a paycheque.

      [0]
    • Cody Kenneth James Winstone yes but unlike the servers they get a wage a lot different than base wage

  20. Where I work we tip out 6% in total. Bartenders, support staff and kitchen get tipped out and we still walk with good money. However if you aren’t walking with tips after that and “owe” money it’s time to find a different serving job!

  23. I expect taking a percentage when there is tips to spread around amongst the staff but they can’t expect you to make a minimum amount of tips, and most certainly if you don’t take it out of your pay. That’s ridiculous

  24. I just did the math I tip like $960 per year I think I’ll start a tip jar for myself. Nobody tips me at my work. I’ll call my new fishing boat tipsie.

  27. None of what you are saying is what any reputable restaurant would do. If you have serving experience go find another job ASAP. Nothing wrong with working at a chain restaurant. Don’t get stuck being used. Already hard enough serving without getting screwed on $$.

Every single restaurant that has table service and most bars have this in place. You’d be hard pressed to find one that doesn’t require waitresses to tip out.

      [0]
    • Trish Down i was a server for a long time so I totally understand tipping. But why doesn’t she have any cash at the end and why are they taking it off her cheque. And why are they taking her personal float $? It just sounds shady. I’ve never worked a day as a server and had to pay out of pocket. Something isn’t right. Just my personal experience but any server job I had where a manager took tips was a terrible place to work. Go find somewhere more reputable

Call the AB Labor Standards and talk to them about your situation. If the owners are in the wrong then report them. The clerk on the phone will help you. They are totally in the wrong and are ripping you off.

  33. Nicole Niska Nicole Niska says:

According to this, which was taken off the labour standards website, tips aren’t covered under labour standards. Not sure about the deductions from paycheques.

Your managers are trash. Management should never be taking any portion of tips. Some of them claim it’s to cover credit and debit transactions, which really is a business expense that they should be covering themselves, or get rid of the option altogether and have an atm on-site.

you’re blooming employer is greedy!!! Where in the world do they get off expecting ANY Portion of your tips!??? Are you Kidding me???? If they can’t do Exactly what they’re supposed to do which is just pay you & KEEP Their Paws out of your tips THAT YOU WORK FOR!!!!

Any and all shortages were taken from employee pay, even if it was a gas and go.

Let’s solve the problem! The owners took on that business knowing what they were getting into. They have a service, if they can’t make it without STEALING from their workers then get out of that business. That’s why we have a governed minimum wage– because u r a minipulateing $#@&*. No one tipped me for cleaning up their kids puke etc. on the school bus.
